Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

SECTION 1 - ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall Accommodation @ Curlewis, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Accommodation @ Curlewis and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

Payment Terms

Credit card required at time of booking to confirm reservation.

Super Saver Rates required full payment taken at the time of booking, rates are non refundable and non changeable.

Full payment will be deducted from the credit card provided 2 days prior to check in, from 7:30am.

Credit card payments will incur a surcharge. VISA and MASTERCARD 1.25%, DINERS AND AMEX 1.75%.

Guests credit limit on their room account is a maximum of $500. Once the credit limit hits $500 the credit card we have on file will be charged.

A credit card pre-authorisation of $250 may be required on check-in. This will be held on the card as a 'pending' transaction for a period of up to 7 days ("holding period"), depending on your card issuer.

All rates are in AUD, inclusive of GST unless otherwise specified.

Members and Staff must show appropriate membership ID to receive relevant discounts.

 

After Hours Reception

Accommodation @ Curlewis employs a third party after hours’ reception provider.  While every effort is taken to provide updated and accurate information, we cannot guarantee this.

 

Cancellation Terms

Full cancellation fee applies from 7:30am, 2 days prior to check in.  No amendments or credits are allowed after this time when full payment has been taken.

No refunds, credits or amendments to bookings within 2 days of check in unless approved by Accommodation @ Curlewis Management.

If any payment is not received by the Payment Date, Accommodation @ Curlewis reserves the right cancel the booking.

If you do not check in for your booking, full cancellation fees apply.

 

Golf Course Access

Access to the Curlewis Golf Course is limited to Members and Visitors booked to play via the Club’s Golf Booking System or through the Pro Shop. By signing the Guest Registration form, you become an Accommodation Member of Curlewis Golf Club Social Club and agree to abide by its Rules. For safety reasons, we strongly advise guests NOT to casually walk on or around the golf course whilst golfers are playing.  Curlewis Golf Club will not accept responsibility for any injury sustained to person or property if this advice is not adhered to. Please note, Curlewis Golf Club is located alongside the renowned Bellarine Rail Trail, a purpose designed walking trail – the gateway to multiple scenic walking tracks around the area.  Please note guests can purchase drinks from the pro-shop for on-course consumption, no BYO is permitted.  Only the eskies provided and from the pro-shop will be allowed on the golf-carts, guests can not bring their own.

 

Non playing guests can accompany Partners or friends booked into play as long as the Pro Shop is notified in advance of the play commencing.

 

 

Cleaning

General and normal cleaning is included in the room cost. Additional cleaning charges may be incurred where a guest has created cleaning requirements considered in the reasonable opinion of Accommodation @ Curlewis to be over and above normal cleaning.

 

COVID-19

Accommodation @ Curlewis and all levels of operation within the Curlewis Golf Club facility are committed to following a rigid Covid Safety Plan as relevant and applicable to Government regulations and directives at any point in time. The health and safety of our patrons, staff and community is of paramount priority.   Accommodation @ Curlewis will keep in line with the current government mandates & regulations. If guests do not follow the mandates & requirements they will be asked to leave and no refund or credit will be offered and full payment will be forfeited.  If you are feeling unwell or showing Covid-related symptoms (fever, cough, cold, aches, nausea, loss of sense of smell/taste), please remain away from the Accommodation @ Curlewis facility until you are feeling 100%.

 

Emergency Services

If an emergency service (Ambulance, Police, Fire or other authority) is required to be called for the safety of the guests, employees or property, the expense may be passed to the guest if they are found to be negligent, mischievous or reckless and/or not following hotels terms and conditions.

 

Eviction Notice

Accommodation @ Curlewis reserves the right to evict any person(s) from the premises immediately and without notice or refund for any disturbances or unruly behaviour causing disruption to other guests.  Accommodation @ Curlewis has a strict no party policy in rooms.

Accommodation @ Curlewis also reserves the right to charge guest(s) for all damages and breakages, missing items, late departure, extra cleaning, and unpaid expenses. Any additional charges will be debited from the credit card provided.

Only the designated persons on check-in are permitted to stay in the rooms.  Any additions to this may be charged the average nightly rate for the duration of the booking and all occupants may be required to leave the premises.

Accommodation @ Curlewis will not be responsible for any misinterpretation or misunderstanding about the premises booked and our cancellation policy will apply.

 

Force majeure

Accommodation @ Curlewis is not responsible for any loss arising out of any occurrences or conditions beyond its’ control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.

 

General Terms

We try to make sure the content of the website is accurate, although we cannot guarantee this.

Photos and floor plans are indicative only.  Actual rooms occupied may vary in décor and inclusions from those shown.

 

Gift Vouchers

Accommodation @ Curlewis requests any payments via gift voucher be presented at the time of reservation, or at last 72 hours prior to your stay.

 

Golf

Tee-times are subject to availability at the time of booking.  Please ensure that you check in for your tee-time 15min prior in the Pro-Shop.

 

Hotel Booking Terms

Rates are based on twin or double occupancy (excluding Eagle Suites which have a maximum of 3 adults).  No additional guests are permitted in any rooms.

No cots are available for hire.

Children and infants may not stay in any room without a responsible adult over the age of 18.

The minimum check-in age is 18 years old. An acceptable form of photographic identification may need to be produced on check-in.  All guests under the age of 18 must be accompanied by a responsible adult such as a parent, step parent, guardian or other adult who has parental rights and responsibilities for the under 18-year-old guest.  If a guest is found to be a person under the age of 18 who is not accompanied by a responsible adult Accommodation @ Curlewis may immediately cancel the guests booking and the full booking amount will be forfeited to Accommodation @ Curlewis under this clause.

All guests may be required to provide photographic identification.  If you are unable to provide such identification your booking may be cancelled and you may be liable to pay Accommodation @ Curlewis an amount equal to the full booking amount plus any other cost incurred by Accommodation @ Curlewis in connection with the booking.  Accordingly, any pre-payment you have made in relation to the booking will be forfeited to Accommodation @ Curlewis under this term.

 

Housekeeping

During a multiple night stay you may be offered to “Go Green” this means to skip a service of the room if you choose. Every 4^th day a full service including a linen change is required and housekeeping will require access to the room.

If the ‘do not disturb’ button is pushed up until and past 2pm, no daily servicing will be provided. Housekeeping must have access to the room every 4^th day for a full service including linen change. Housekeeping will endeavour to supply additional towels and amenities upon request. During room servicing, guests will not be permitted access to their rooms to void close contact with guest and team.  Housekeeping will not service a room should it be deemed excessively messy. Personal items left on beds or cupboards preventing cleaning or making of beds will not be moved by the housekeeping team and may result in a limited servicing of the room.

 

House Rules

We respect all guests in house and ask all other guests to do the same in relation to noise and behaviour. Guests and invitees are expected to behave in a manner which is conducive to the safety, comfort and convenience of other guests within the property at all times.  The carrying on of any form of business, manufacture, industry or other commercial activity in the rooms is not permitted under any circumstances. A breach of any house rules including the house rule in relation to no business being conducted in the rooms by guests or invitees of guests may result in the eviction of the offender guest and any invitee of a guest at the discretion of Accommodation @ Curlewis Management. 

 

Insurance

We strongly recommend travel insurance should any stay need to be altered or cancelled before, during or following arrival for any reason or circumstances including natural events.

 

Luggage Storage

Limited storage facilities are available at reception, Accommodation @ Curlewis will not accept any responsibility for damage or loss of equipment or goods left at reception prior to, during, or after your stay.

 

Miscellaneous Charges

Accommodation @ Curlewis reserves the right to debit the credit card provided with a $250 pre-authorisation.

The credit card onfile will be used for any fees incurred during your stay including, but not limited to, additional cleaning, excess rubbish removal, extra bedrooms occupied, extended stays, late checkouts, smoking in a property, lost keys & any additional locksmith fees, unnecessary maintenance attendance, repairs or damage to property, additional fees from the usage or damage from any of Curlewis Golf Clubs venues or property including but not limited to Claribeaux Restaurant, Spike Bar, Pro Shop, The Range @ Curlewis, Flying Brick Cider House, Jack Rabbit Winery and Leura Park Estate.

Guests credit limit on their room account is a maximum of $500. Once the credit limit hits $500 the credit card we have on file will be charged.

Where a credit card is not available a minimum $250 cash deposit may be required on check in.  Charge back facilities will not be available.

Accommodation @ Curlewis reserves the right to debit the credit card provided on file for $25 per room key that is not returned on check out.

Quoted rates are inclusive of all compulsory government or regulatory rates and taxes (for ex GST) where applicable.

Any confirmed price is subject to change if:

A payment which is due on a booking is not received by Accommodation @ Curlewis by the due date or

There is a change of a government charge, tax or levy which requires Accommodation @ Curlewis changing the rate on your booking.

 

Photographs & Descriptions

Whilst care is taken to ensure that photos and description of our facilities and services is accurate, these are continually being changed, upgraded and on occasion, removed from service.  If any feature or facility is essential to you in choosing a particular room or service, we highly recommend advising reception at the time of booking.

 

Photo Identification

Valid photo identification (ID) matching the name of the registered guest within the reservation may be requested at the time of reservation or check-in. A valid Australian driver’s license, Australian issued Proof of Age Card or an International Passport are all acceptable forms of photo identification.

 

Privacy

Only the guests’ names on the booking will be entitled to access and/or amend any personal information pertaining to that booking.  No information can be given to any 3rd parties unless permitted by the guest/s or required by law.

 

Property Features

Your rooms will be serviced daily, if you are staying for an extended period, your linen will be changed every 4 days of your stay.

First level rooms are only accessible by stairs.

Complimentary wifi is available throughout the property.

Complimentary car parking for 1 car included per suite.

Reception hours are 6:30am – 9pm.

Check In: From 2pm, Accommodation @ Curlewis will make every effort to ensure your rooms are available at your time of check-in.  If you wish to check in prior to 2pm, or stay later than 10am, you must book and pay an additional night’s stay.

Check Out:  Before 10:00am. If you have not vacated the room by this time a late fee may be applicable, unless a late departure time has been approved prior.

Accommodation @ Curlewis is wheelchair friendly, please advise reception when booking.

Pets are not permitted; however, we do allow for certified guide dogs assisting visually impaired guests. Any guest found to be in breach of our pet policy will incur a $300 additional charge to their credit card supplied to cover the cost of cleaning.

 

Room Access

Accommodation @ Curlewis reserves the right to access your room at their discretion to ensure the rooms are being kept in good condition and to check on the safety of its guests.  If at any time there are concerns about the state of the room or the safety of its guests, Accommodation @ Curlewis will access the room as a duty of care towards the guests and to protect its assets.

 

Room/Package Conditions

Stay & Play inclusions – 18 holes of golf per person, breakfast and nightly room tariff.  Tee-times must be arranged within 48 hours of reservation to ensure suitable availability.  Whilst all efforts will be made to meet your requested tee time, they are not guaranteed until booked.

Additional rounds can be reserved for in-house guests subject to availability.

Rate is room only unless advised, breakfast is at an additional fee.

The children’s breakfast rate is for children 12 years old and under.

 

Smoking

Accommodation @ Curlewis is a non-smoking facility (both in the suites and on the balconies) and as a result where management determines the presence of any smoking residue in any suites/balcony, a $300 additional cleaning charge will be applied to the credit card supplied to cover costs of dry-cleaning of curtains, furnishing etc.

There are 2 designated smoking areas within the Accommodation @ Curlewis precinct.

 

Special Requests

Whilst Accommodation @ Curlewis will attempt to satisfy all special requests, we cannot guarantee they will be accommodated.

 

Theft

Care should be taken at all times with all valuables left in guest rooms, vehicles or on the property facilities.  Guests are encouraged to make full use of available safe in all guest suites.  Limited storage facilities are available at reception.   Accommodation @ Curlewis will not accept any responsibility for damage or loss of equipment or goods left at reception prior to, during, or after your stay.
